Are you covered under the "Be a manager, go to jail" law?

If you are a manager, you may want to take note. There is a law on the books that will directly affect you. It's the Corporate Criminal Liability Act ("CCLA"), but attorneys are calling it the "Be a Manager, Go to Jail Act" and it is a potential trap for you.

The CCLA states that anyone "who is a manager with respect to product, facility, equipment, process, place of employment, or business practice" is guilty of a misdemeanour or felony if they: (1) have actual knowledge of a serious concealed danger; and (2) fail to report that danger to the affected employees and the Department of Industrial Relations (DIR). Violation of the Act is punishable by up to three years in state prison and a $25,000 fine.

Did you know that:

  • Employees must be safety trained before starting to work for you or in a new department
  • Forklift training is mandatory for any size company. How's Your Forklift Safety Program? Does it meet OSHA's requirements?
  • Forklift training must be done on your site before an employee can operate a forklift and you must show proof of training and testing by a qualified trainer
  • You must have a specific written safety program if your company has over 9 employees. IIPP (Injury and Illness Prevention Plans)
  • You must have a formal safety committee if your company has over 40 employees. See requirements.
  • Hazardous Materials training is required for all employees before they enter the affected areas
  • 92% of all accidents are preventable
  • The lack of training costs much more than the actual training
  • OSHA or your local fire department can shut you down on the spot for serious violations

All you need is one disgruntled employee to call OSHA. Don't take a chance!  Protect yourself and your company by getting proper training for your staff. It might be the best decision you've ever made!
